Welcome to BNT Flashcards! These Terms of Service ("Terms") govern your use of the BNT Flashcards mobile application and website (collectively, the "Service") operated by BNT Flashcards ("we," "us," or "our").

Please read these Terms carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Acceptance of Terms

By creating an account or using the BNT Flashcards Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users of the Service.

2. Description of Service

BNT Flashcards is a language learning application that uses spaced repetition flashcards to help users learn and retain vocabulary. The Service includes:

• Flashcard creation and management
• Spaced repetition study system (SM-2 algorithm)
• Progress tracking and statistics
• Pre-made deck library
• Cloud synchronization (for registered users)
• Premium features (for subscribers)

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3.3 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be inappropriate or harmful.

4. Subscriptions and Payments

4.1 Free and Premium Services

BNT Flashcards offers both free and premium subscription plans. Free users have access to basic features with certain limitations. Premium subscribers have access to all features without limitations.

4.2 Subscription Terms

Premium subscriptions are available as:

• Monthly subscription: Billed monthly
• Yearly subscription: Billed annually at a discounted rate
• Lifetime access: One-time payment for permanent access

4.3 Billing and Renewal

Subscriptions are processed through the Apple App Store or Google Play Store. Payment will be charged to your account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

4.4 Cancellation

You may cancel your subscription at any time through your device's subscription settings (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period. No refunds are provided for partial subscription periods.

4.5 Free Trials

We may offer free trial periods for premium subscriptions. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

4.6 Price Changes

We reserve the right to change subscription prices. Price changes will not affect existing subscriptions until the next renewal period. We will provide notice of price changes in advance.

5. User Content

5.1 Your Content

You retain ownership of any content you create using the Service, including flashcards, decks, and study materials ("User Content"). By creating User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.

5.2 Content Responsibility

You are solely responsible for your User Content. You agree not to create or share content that:

• Infringes on intellectual property rights of others
• Contains unlawful, harmful, threatening, or harassing material
• Contains viruses or malicious code
• Violates any applicable laws or regulations

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine to be inappropriate, at our sole discretion.

6. Intellectual Property

6.1 Our Content

The Service and its original content (excluding User Content), features, and functionality are owned by BNT Flashcards and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

6.3 Restrictions

You may not:

• Copy, modify, or distribute the Service or its content
• Reverse engineer, decompile, or disassemble the software
• Remove any copyright or proprietary notices
• Use the Service for any commercial purpose without authorization
• Attempt to gain unauthorized access to any part of the Service

7. Pre-Made Content Library

BNT Flashcards provides a library of pre-made flashcard decks. This content is provided for educational purposes only. We do not guarantee the accuracy or completeness of this content. Pre-made decks may be updated or removed at any time.

8. Third-Party Services

The Service may contain links to or integrate with third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or harmful components
• The results of using the Service will meet your requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BNT Flashcards, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability shall not exceed the amount you paid us in the twelve (12) months prior to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless BNT Flashcards and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including intellectual property rights
• Any claim that your User Content caused damage to a third party

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within [Your Jurisdiction].

13. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, either party may pursue formal legal remedies.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

16. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of BNT Flashcards.

17. Entire Agreement

These Terms, together with the Privacy Policy and EULA, constitute the entire agreement between you and BNT Flashcards regarding the Service and supersede all prior agreements and understandings.
